Separation Agreements
If parties can resolve issues after separation, it is important to put the terms of the agreement in writing. This is known as a separation agreement, and is binding on the parties. This is often quicker and less costly than proceeding to court.
It is highly recommended that both parties have separate lawyers to provide independent legal advice, so that the parties understand the risks and consequences of what they are signing.
Full financial disclosure should be provided by both sides, to ensure that all information is present so a proper decision can be made.
Having independent legal advice and full financial disclosure can also help reduce the chance of one party successfully applying to the court later on to have the terms set aside.
